Delivery times are also indicated when the order is validated; they are calculated in working days (Monday to Friday, excluding public holidays).
The customer must measure the access points to their home in order to confirm to the carrier that the product ordered can be delivered.
In the event of false information or incorrect measurements provided by the customer, any additional costs relating to the hire of lifting equipment, storage, return of goods or additional delivery staff will be borne exclusively by the customer.
In general, if carriers are unable to deliver the products on the agreed date and time due to the customer's absence or delay, or to a lack of information on the need for specific delivery means, additional delivery costs may be charged by alexandrelunetier.com.
The customer must check that the information provided to alexandrelunetier.com when ordering, in particular the delivery address, is complete and accurate.
The customer is responsible for the information provided at registration and when ordering.
alexandrelunetier.com cannot be held responsible for any input errors that may lead to delivery errors, and/or for the customer's failure to comply with the delivery terms and appointments they have arranged with the carrier.
Any irresistible, unforeseeable events or circumstances beyond the control of the parties, in particular total or partial strikes by carriers and natural disasters such as floods or fires, are considered acts of God or force majeure exempting from liability.
Products can only be shipped within mainland France and Monaco.
If the customer wishes to postpone the delivery date (for serious reasons only), they must notify alexandrelunetier.com by email at the following address: alexandrelunetier@gmail.com
In the event of a claim concerning any defects or signs of deterioration of the products (damage, product missing compared with the delivery note, damaged parcel, broken products, etc.), the customer must record their observations on the delivery note and confirm them by email to: contact@alexandrelunetier.com
Except in cases of hidden defects, no claim or reservation will be accepted after the customer has received the products if the customer has not followed the procedure described above.
If the delivery date is exceeded by more than 7 working days, in the absence of force majeure and in accordance with Articles L114-1 and L121-20-3 of the French Consumer Code, the customer may terminate the contract by registered letter with acknowledgment of receipt.
The contract is considered terminated upon receipt by alexandrelunetier.com of the letter in which the customer informs it of their decision.
Only cancellations sent by registered letter with acknowledgment of receipt no later than 60 working days after the expiry of the deadline or scheduled delivery date, and received before delivery of the products concerned, will be taken into account by alexandrelunetier.com.
The amounts paid for the order will then be refunded to the customer.
Please note that the delivery time may be extended to between 10 and 14 weeks in the event of the sale of a second stock of products, as part of a flash sale as provided for in Article 1 hereof.
In any event, the customer will be informed of the delivery time when validating their order.
Article 11 - Withdrawal
In accordance with Article L 121-20 of the French Consumer Code, the customer has a withdrawal period of 14 full days from delivery of the product, allowing them to cancel their order and return the product at their own expense, together with the invoice and the duly completed and signed return form.
These provisions do not apply to any order placed by the customer for a made-to-measure product ordered online and/or manufactured to the customer's specifications and/or personalized, or which, by its nature, cannot be returned or is liable to deteriorate.
In the event of the return of goods referred to in the first paragraph of this article, the customer bears the transport risks.
Any withdrawal must be reported to alexandrelunetier.com customer service by email at: contact@alexandrelunetier.com
The cost of sending the registered letter may be refunded on request.
alexandrelunetier.com will then contact the customer by email or telephone to arrange the return of the products, and a return number will be assigned to the customer.
The customer must follow the return procedure.
No return will be accepted if the procedure for notifying alexandrelunetier.com of the return has not been followed.
Only products in new condition, complete (accessories, cushions, instructions where applicable) and in their original packaging will be accepted.
Any product damaged by the customer, or whose original packaging has been damaged beyond simple opening, will not be refunded, or will be partially refunded.
The periods mentioned above run from the day the order is received.
This legal right of withdrawal is exercised without penalty, with the exception of shipping costs.
The legal warranty (Article 1641 of the French Civil Code) does not apply to the repair of damage resulting from a cause external to the product or from the customer's actions.
In the event of a refund, the customer is refunded by check, credit to their bank card or bank transfer. Refund methods are at the discretion of alexandrelunetier.com.
Returns remain at the customer's expense and risk.
For this reason, alexandrelunetier.com advises its customers to take out specific insurance with the carrier for the market value of the products. This is necessary for the customer to protect themselves against any damage, theft or loss of the products by the carrier.
Article 12 - Warranty
Products (excluding consumables) are guaranteed against any lack of conformity and hidden defects under the conditions provided for by the French Consumer Code and Civil Code.
The customer must report defects to alexandrelunetier.com as soon as they appear, by sending photographs.
The liability of alexandrelunetier.com is limited to the price of the defective or non-conforming products and, in general, whatever the cause or form of the action concerned; alexandrelunetier.com cannot be held liable for indirect damage or any other financial loss suffered by the customer or a third party.
The choice and purchase of goods is the sole responsibility of the customer. Consequently, total or partial inability to use the products, in particular due to incompatibility of equipment, cannot give rise to any compensation, refund or liability on the part of alexandrelunetier.com, except in the case of a proven hidden defect, non-conformity, defect or exercise of the right of withdrawal provided for by the French Consumer Code.
Article 13 - Data protection
In accordance with French Data Protection Act No. 78-17 of 6 January 1978, the customer has the right to access and rectify their personal data and may exercise this right by sending an email to: contact@alexandrelunetier.com
Depending on the customer's choices when creating or modifying their account, they may receive offers from alexandrelunetier.com.
If they no longer wish to receive them, they may at any time request this from alexandrelunetier.com via their customer account or by writing to the address above.
alexandrelunetier.com informs its customers that this automated processing of information, in particular the management of users' email addresses, has been declared to the CNIL.
Article 14 - Dispute resolution and severability
These General Terms and Conditions of Sale shall be performed and interpreted in accordance with French law.
Before any litigation, the parties will seek an amicable settlement. Failing an amicable agreement, any dispute of any kind or challenge relating to the formation or performance of the order, even in the event of a third-party warranty claim or multiple defendants, shall fall under the exclusive jurisdiction of the courts of the place where alexandrelunetier.com has its registered office.
If any clause of these general terms and conditions of sale becomes null, unenforceable, void, illegal or inapplicable as a result of a law, regulation or final decision of a competent court, this shall not affect the validity, legality or applicability of the other provisions of these general terms and conditions of sale and shall not release the customer from performing their contractual obligations.
